Ontheside Privacy Notice

We, Ontheside, respect your privacy. And, we understand that when you use Ontheside services and provide information to us, you are expecting us to protect that information (data) and use it only for the purposes of providing you with a great experience on Ontheside.com. This Privacy Notice is intended to explain what information we gather and why, who has access to it, and how you can update, manage, and delete your information as you like, in accordance with US state and federal data privacy laws and the EU General Data Protection Regulation (the GDPR).

Who we are:

Ontheside.com services are provided by Ontheside, Inc. (hereinafter, Ontheside) which is a corporation organized under the laws of the State of Delaware, USA, and operating under the laws of the USA. Our mailing address is 703 Pier Ave. Ste B226, Hermosa Beach, California 90254, USA. 

We, are the ones who determine the purposes and means of the processing of your personal data described in this Privacy Notice, the data controller. Personal data is any kind of information that can be linked to a living person. This might for example be your name, address and personal identity number.

What we do:

We bring two parties together - those with digital content they wish to provide to others (let’s call them providers) and those who wish to gain access to that content for a fee (let’s call them consumers). Depending on how you wish to use the Ontheside.com platform, you can opt-in for as much or as little information as you wish to provide; the services available are then dependent on your choices.

For providers, our services are designed to let you upload, store, create, and share content, to promote digital content and services, and to offer access to that content to the public for free or a fee. Providers are under no obligation to provide any content or services and can choose whether they do so or not. If you do decide to provide access to your digital content and include that content within a Track with a designated rate, Ontheside is allowed to make that content available for sponsorship; if sponsored by a Consumer, Ontheside will pay Provider a service fee determined as a percentage of the published sponsorship rate. 

For consumers, our services are designed to let you view, filter, sort, organize, and follow your favorite Providers, and if you so choose, to sponsor and interact with them by electing to subscribe to one or more content Tracks.

What information we use and for what purposes:

  1. There are several categories of information you provide to Ontheside, such as account data. Account data allows you to create an account. We start by collecting personal user data - user name, email and password. This forms the foundation of your account. With this basic information, you are able to follow athletes, teams, clubs and other providers, save events to your calendar, and appear in a provider’s list of followers. 

    The legal basis for our processing of your account data is entering into a contract between us and you (article 6.1 (b) of the GDPR).

  2. Profile data is just that - information about you on your profile. In order to create a profile that fans or consumers can follow and sponsor, we ask for more detailed information about you in order to list you on the Ontheside.com platform. This profile information allows you to present yourself to consumers - we ask you to include your bio, location and basic stats, your accomplishments and rankings, events you plan to attend, and your affiliations with organizations like teams, clubs, and associations. And while we prefer you complete all the fields, please know that this information is optional. That said, since our platform is intended for athletes, teams and the like to highlight their accomplishments and incentivize fans and brands to sponsor them, we do recommend completing all the fields; the more we know, the better we can match you to fans and fans to you.

    The legal basis for our processing of your profile data is our legitimate interest of providing your and our customers the best services (article 6.1 (f) of the GDPR).

  3. As for the financial information we collect, it is required to enable two functions:
    1.  it allows you (Consumers) to sponsor athletes, teams, clubs, events and other providers;
    2.  it allows Ontheside to pay out license fees owed to you (Providers) for sponsored content.

    When you decide to become a more active Consumer on the platform, your credit card is how you are able to sponsor athletes, teams, clubs, events, associations, etc. It is currently the only form of payment Ontheside.com supports. If you decide to become a Provider and get listed on the Ontheside.com platform, we require bank information so that you are able to pay out via wire sponsorship funds. That said, payment processes are really complex. As such, Ontheside has leveraged Netsuite, BlueSnap, and Avalara to managed the subscription, payment process, and tax workflows.

    When you set up your financial accounts with Ontheside, you may be asked to provide more personal information such as name, address, phone number, and credit card information (so that you might be a sponsor), bank account information (so that you might receive sponsorship funds), and even country of citizenship, tax ID number, social security or employer identification number, date of birth, and copies of ID and proof of residency (in order to properly report your income to the appropriate tax authorities). Please understand that the information we gather is to properly set up your financial accounts, no more, no less.

    The legal basis for our processing of your financial data as described above is the fulfillment of a contract between us and you (article 6.1 (b) of the GDPR).

  4. So far, we have discussed information you provide to Ontheside. Since this is a platform designed for you to share your content to consumers or your fans, you must understand that you are also sharing your information with them and this community. This means your name, bio, stats, personal statements, accomplishments, events, affiliations, images, video content, podcasts, written blogs, newsletters, guides or the like, training programs, messages, published services, comments, likes, and anything else you publish on Ontheside.com is available to the community. 

    While this is the point of the platform, we just want to make sure it is clear to you. We should also make it clear once again that information you provide and publish is optional; you are welcome to delist your profile at any time.

    The legal basis for our processing of the other personal data that you share with us is our legitimate interest of providing your and our customers the best services (article 6.1 (f) of the GDPR).

  5. When you submit support requests, feature ideas, survey responses, or communicate with Ontheside through messaging, email, text, phone, mail (for those who believe in a more traditional way of communication) or the Ontheside.com platform itself, we will record, store, analyze, utilize such communications to support you, develop and enhance features to provide you a great experience.  

    Also, we will use these methods to interact with you directly (probably not mail, but other modern methods of communication). Please understand that you relinquish any intellectual property rights or otherwise in any communication content you submit to Ontheside directly or through the Ontheside.com platform. 

    In addition, we may use the above methods to provide you with notices, service updates, new features announcements, or even suspicious activity warnings. Again, all of these communications will be recorded and stored so that we can provide a high level of service and support to you.

    The legal basis for our processing of your communication and interaction data is our legitimate interest of providing you support and providing you the best services (article 6.1 (f) of the GDPR).

  6. In addition, we also gather data in the background to enable features and services, to provide analytics to providers and corporate sponsors, to provide marketing and promotional information to you, and to leverage data to improve performance and experience.

    For example, we store and organize the content you upload and create (this includes things like photos, videos, podcasts, newsletters and blogs, training programs, gear and nutrition guides), the activity within our platform (which may include comments, likes, and ratings), the messages you send and receive through the system, any notifications, and also display preferences (such as fonts or background colors). This is necessary for Ontheside.com to operate as designed.

    The legal basis for our processing of your usage data is the fulfillment of a contract between us and you (article 6.1 (b) of the GDPR).

  7. In addition, by tracking interactions on the Ontheside.com platform, we can provide analytics to content providers regarding what types of sports consumers might find interesting, subject matter (like nutrition, gear, recovery) that is trending, events in the area or around the world using geolocation, media forms (for example, podcasts or videos, etc.) that are preferred. The objective here is to provide analytics to support decision-making for providers so that they can deliver what consumers want and for consumers to find what interests them. It also allows us to provide marketing and promotional materials to you that would enhance your experience.

    The legal basis for our processing of your usage information is our legitimate interest of providing your and our customers the best services (article 6.1 (f) of the GDPR).

  8. Lastly, we gather system data about you from your device to improve your experience. For example, we gather your chosen default language and settings, browser type and settings, device type, GPS data, operating system, and IP address. By having this system data, we can utilize default languages, fonts, color preferences, and display size to improve how Ontheside.com is displayed on your device of choice.

    The legal basis for our processing of your technical information is our legitimate interest of improving our services (article 6.1 (f) of the GDPR).


At Ontheside, we believe in user experience and continuously working towards that experience. So, it goes without saying that we will do our best to maintain a high level of innovation and feature delivery. As part of our process of innovation, we plan to leverage the analytics we capture from the data to develop new features, to utilize AI and machine learning to automate a number of processes such as analyzing for security risks, spam, malware, or illegal content, and to build systems to track performance and content consumption to ensure that the Ontheside.com platform works as designed. These are all good things we do for you so that you can get the most out of Ontheside.com and feel comfortable not only using our platform but sharing it with the world.

How we handle third party integrations:

While some enterprise systems are integrated in the background to handle financial, tax, or accounting processes, other customer facing systems that allow you to publish content to other social media platforms or to benefit from single-sign-on functionality are directly accessible by you. In such cases, your login information or other account information may be necessary for the service to operate. You will need to grant Ontheside access to these third-party accounts when you connect to these services. 

For enterprise systems integrated in the background, only the necessary user information is shared between platforms to allow for appropriate accounting of revenue, reporting for taxes, and the collection and distribution of funds. Other enterprise systems integrated with the platform include, but are not limited to: website hosting; customer support services; CRM services, messaging, notifications and email services; security services; content delivery networks; traffic and usage analytics services; and cloud storage services. Where appropriate, data is aggregated and anonymized to and from these systems and the platform.

How long do we keep your information?

We keep your personal data for no longer than necessary for the purposes for which the personal data is processed. When deciding how long your personal information will be kept, we examine whether it is necessary to keep the personal data collected and, if retention is required, work to retain the personal data for the shortest possible period. 

Please note that we may continue to keep your personal data thereafter to comply with our legal and regulatory obligations as described above, but also on basis that it is necessary for the establishment, exercise or defense of legal claims.

What we do to be safe and secure:

The world is a complex place where at times, it seems as if it is polarized by and paralyzed with conflict. We ask that you be a good human to use our platform. We also know that even if all users are good humans, there are humans outside of the platform that will do their best to disrupt services or cause harm to individuals or groups on the platform. So, we will do our best to provide a safe and reliable environment to allow all users to achieve their goals and to ensure the platform can operate as intended and designed.

Our objective is to detect, prevent and respond to any abuse, security risks, technical issues, fraud or misrepresentation, spam, malware, or illegal content uploaded to our platform. Part of this will be automated with different technologies and algorithms to recognize patterns in the data, and part of this will be manual, with actual humans investigating and addressing the issues uncovered. In conducting the above activities, it is possible that we will utilize the information you have provided (account, profile, financial). If specific information is not already covered within this Privacy Notice, Ontheside will request for your consent in advance of using the information. Our hope is to minimize any such activities and work together with you to resolve any problems as soon as possible. 

When we share your information:

We may share your data in cases we engage third-party service providers and partners in order to perform service on our behalf, for example to provide IT or system services, such as payment service providers. We may also share your data with our subsidiaries and affiliates to provide the services you want, such as customer support, technical operations. In such cases the recipients act as our data processors, complying with information in this Privacy Notice.  

If mandated by law, we may also share your account, profile, or financial data with authorized regulatory, prosecuting, tax or governmental authorities, courts or other tribunals in any jurisdiction or markets, domestic or foreign. In cases where government or law enforcement officials request such information, you will be notified by Ontheside of the request. The legal basis for our sharing of such information is our compliance with legal obligations (article 6.1 (c) of the GDPR). Please do however note that the recipient is responsible for the future handling of your personal information. This Privacy Notice does therefore not apply for the further processing in such cases. 

Where do we process your personal information?

Some of our partners and suppliers may have part of their operations in countries outside of the EU/EEA (so called third-countries). Transfers only takes place to countries that the European Commission has declared to provide adequate level of protection.

The European Commission has concluded that the United States ensures an adequate level of protection for personal information transferred from the EU to companies participating the EU-U. S Data Privacy Framework.

If there is no decision from the European Commission or companies in the United States do not participate in the EU-U:S Data Privacy Framework, transfers only take place to countries where the transfer of the personal information is subject to appropriate safeguards, such as the EU Commission’s standard contractual clauses. 

Your rights as a data subject:

Under the GDPR you have several rights as a data subject.

  1. You have the right to request information about our processing of your personal information. You also have the right to request a copy of the personal data we use about you.
  2. You have the right to request that inaccurate or incomplete data about you is corrected or completed.
  3. You have the right to object to your personal data is being used on the legal basis of our legitimate interest (article 6.1 (f) of the GDPR). Please note that if we can demonstrate that our legitimate interest in the processing outweighs your interests and rights, we may continue processing despite your objection.
  4. You have the right to limitation of the processing of your personal data in some cases, such as the personal data Is no longer necessary for the purposes for which it was collected.
  5. You have the right to be given and use your personal data elsewhere in some cases (for example on the basis of fulfillment of contract article 6.1 (b) of the GDPR), meaning to have your data transferred to another data controller (data portability).
  6. In cases where personal data is based on consent (article 6.1 (a) of the GDPR), you have the right to withdraw your consent at any time. When you withdraw your consent, we will stop any processing of personal data which is based on the consent.
  7. You have the right to not be subject of a decision that is only based on some form of automated decision-making, including profiling, if the decision can have legal consequences for you or in a similar war affects you to a considerable degree.
  8. You have the right to request that data relating to you is erased in some cases, for example if the personal information is no longer necessary for the purposes for which it was collected, you object to the processing and there are no overriding legitimate grounds for the processing.

We understand that when you use Ontheside services and provide information to us and give us the ability to capture and analyze your data, you are expecting us to protect that information and data, and use it only for the purposes of providing you with a great experience.
